naturalization

Naturalization is one of the ways of acquiring French nationality. It involves the granting of French nationality by the public authorities, at the request of a foreigner habitually and regularly resident in France. This process represents a key, often final, stage in the integration of a foreign national into the French community. The administrative judge frequently points out that"naturalization is not a right, but a favor granted, in which the Minister of the Interior has a wide margin of discretion". Action to declare or deny nationality

According to article 29-3 of the French Civil Code, "any person has the right to take action to decide whether or not he or she is French. This is a civil procedure to be initiated with the competent court, which will be the Paris court if you live abroad.

This procedure is particularly aimed at people from former French colonies.

The applicable laws and agreements are numerous, complex and vary according to your country of origin or that of your ascendants, and the courts require great rigor concerning the validity of the civil status documents provided.

Declaration of French nationality

According to article 21-2 of the French Civil Code,"A foreigner or stateless person who marries a French spouse may, after a period of four years from the date of marriage, acquire French nationality by declaration, provided that, at the date of the declaration, the affective and material community of life between the spouses has not ceased since the marriage, and that the French spouse has retained his or her nationality".

A declaration of nationality is also possible, under certain conditions, as an ascendant of a French national or as the brother or sister of a French national.
